The petitioner has filed this writ application seeking a direction to the oppo
site party nos. 1 and 2 to release his salary components from 1.6.1994 in view of the ratio de
cided in the case of State of Orissa and Others v. Pradipta Kumar Sutar and others in F.A.O. N
o.614 of 2012 and in the case of Union of India and others v. Tarsem Singh, (2008) 8 SCC 648 w
ithin a stipulated time.
Mr. Das learned counsel for the petitioner, submits that the petitioner has mad
e a representation to the opposite party No.2, vide Annexure-5, highlighting the grievance. Bu
t then no decision has been taken.
In view of the limited grievance of the petitioners, this Court disposes of th
e writ petition directing opposite party no.2 to dispose of the representation stated to have
been filed by the petitioner, vide Annexure-5, within a period of three months from the date o
f communication of this order in accordance with law. It is made clear that this Court has not
expressed any opinion on the merits of the case.
Requisites for communication of this order to opposite party no.2 shall be fi
led within week.
