01.11.2016 Heard learned counsel for the petitioner and learned Addl. Govt. Advocate.
The petitioner is aggrieved by the fact that, during rotational reservation of seats
for the ensuing Panchayat Samiti Election, the seat of the Panchayat Samiti Member from Kanut
Panchayat Samiti in the district of Bolangir has been reserved for S.C. (Women) category, tho
ugh the same should have been kept open for UR (Unreserved) category.
Taking into consideration the facts and submission and without going into the merit
of the case or claim of the petitioner, this writ petition is disposed of directing the petiti
oner to file a detailed representation along with the certified copy of this order and a copy
of the writ petition containing all the Annexures before the Collector, Bolangir (opp. party n
o.2). Learned Collector, Bolangir shall dispose of the representation of the petitioner withi
n four weeks from the date of its filing, by passing a reasoned order in accordance with the O
rissa Panchayat Samiti Act and other relevant provisions. If necessary, opportunity of hearing
be also afforded to all the parties concerned.
The writ petition is accordingly disposed of.
