02. Heard learned counsel for the petitioners and learned Addition
al Government Advocate.
The petitioners are villagers of Village Tumangapadar, Tapagiri, Panasapadar a
nd Jaduguda. All these villages were the part of Chudangapur Grama Panchayat. On bifurcation
of Chudangapur Grama Panchayat a new Grama Panchayat named Kesariguda has been created and the
aforesaid villages have been kept under the jurisdiction of Kesariguda Grama Panchayat. The p
etitioners want that though Kesariguda is the highest populated village, the Headquarter of th
e panchayat should be located at Tumangapadar, as Kesariguda is surrounded by the hills and na
xalities area.
Taking into consideration the limited grievance of the petitioners and without
going into merit of the case, the petitioners are directed to file a detailed representation
along with a certified copy of this order and a copy of the writ petition containing all the A
nnexures before the Commissioner -cum- Secretary to the Government, Panchayati Raj Department
(Opposite Party No.1) within fifteen days from today.
The Commissioner -cum- Secretary to the Government, Panchayati Raj Department
(Opposite Party No.1) is directed to consider the grievance of the petitioners within four mon
ths from the date of receipt of a certified copy of this order. If necessity arises, the petit
ioners and other concerned parties may be given opportunity of hearing in the matter and a rea
soned order in consonance with the guidelines of the Govt. be passed by the Commissioner -cum-
Secretary to the Government, Panchayati Raj Department (Opposite Party No.1).
The writ petition is accordingly disposed of.
Urgent certified copy of this order be granted as per rules.
A free copy of this order be supplied to the learned Addl. Government Advocate
for compliance.
