02. 30.08.2016 Heard learned counsel for the petitioners and learned Addl. Go
vt. Advocate.

 The petitioners are villagers of village Barahakana, which was a part of Arjun
pur Grama Panchayat situated at a distance of 500 meters from village Barahakana.

 On bifurcation of Arjunpur Grama Panchayat, a new Grama Panchayat named Badbah
al has been created and village Barahakana is now a part of Badbahal Grama Panchayat, which is
 at a distance of more than 5 K.Ms. from Village- Barahakana.

 The petitioners want that their village Barahakana should be a part of Arjunpu
r Grama Panchayat.

 Taking into consideration the limited grievance of the petitioners and without
 going into merit of the case, the writ application is disposed of directing the petitioners t
o file a detailed representation along with a certified copy of this order and a copy of the w
rit application containing all the annexures before the Commissioner-cum-Secretary to the Govt
., in Panchayati Raj Deptt. O.P. No.1, within 15 days from today.

 The Commissioner-cum-Secretary, P.R. Department is directed to consider the
grievance of the petitioners within three months from the date of receipt of a certified copy
of this order. If necessity arises, the petitioners and other concerned parties may be given

 opportunity of hearing in the matter and a reasoned order in consonance with the guide
lines of the Govt. be passed by Commissioner-cum-Secretary, Panchayati Raj Department.
 Till a decision is taken by the Commissioner-cum-Secretary, Panchayati Raj Dep
tt., the Notification vide Annexure- 1 in respect of bifurcation of Badbahal Grama Panchayat s
hall not be given effect to.
 The writ application is accordingly disposed of.

Urgent certified copy of this order be granted as per rules.

A free copy of this order be supplied to the learned Addl. Govt. Advocate for compliance.
