04.11.2016 Heard learned counsel for the petitioners and learned Additional Govt. Advocate.
The petitioners are the Ward Member and Naib Sarpanch of Diniary Grama Panchayat in
the district of Cuttack. They are aggrieved by the fact that the Sarpanch himself, in complet
e violation of the government guidelines, has prepared a Development Plan for the entire Panch
ayat without bringing the matter to the notice of either the Panchayat or the Grama Sabha.
It is aggreed at the Bar that, by appointing a Nodal Officer, the B.D.O. concerned c
an ask the said Nodal Officer to prepare a fresh Development Plan for Diniary Grama Panchayat
by bringing the matter to the notice of the Grama Sabha and Grama Panchayat in accordance with
the government guidelines as at Annexure-4 to the writ petition.
Learned Additional Govt. Advocate, on instruction, submits that the B.D.O. concerned
has already appointed Shri Ashok Kumar Das, Assistant Engineer, as the Nodal Officer of Dinia
ry Grama Panchayat under Baramba Block.
In view of such facts and submission, this writ petition is disposed of directing th
e B.D.O., Baramba (opposite party no.4) to give proper direction / instruction to the aforesai
d Nodal Officer to prepare a fresh Development Plan for Diniary Grama Panchayat by bringing th
e same to the notice of the Grama Panchayat as well as Grama Sabha, as required under the rele
vant guidelines of the government. The entire exercise be completed by the end of December, 2
016.
