 04.11.2016 Heard learned counsel for the petitioner and learned Additional Govt. Advocate.

 The petitioner, who is the Sarpanch of Marthapur Grama Panchayat in the district of
Khurda, has been put under suspension vide order dated 07.06.2016 under Annexure-4. No ground
 has been mentioned in the said order vide Annexure-4 to justify her suspension. In the meant
ime, Disciplinary Proceeding has already been initiated and charge has already been served upo
n the petitioner.

 In view of the provisions contained in Sub-Section (3) of Section 115 of the Orissa
Grama Panchayat Act, the petitioner is free to appeal to the Government for revocation of the
suspension order. However, this writ petition is disposed of with the direction that, the pet
itioner, within fifteen days from today, shall file proper application before the appropriate
authority under Section 115 (3) of the Orissa Grama Panchayat Act, and the said application sh
all be disposed of by the concerned authority within four weeks from the date of its filing.
The petitioner is at liberty to file fresh writ petition on her failure to get any relief unde
r Section 115 (3) of the Orissa Grama Panchayat Act.
 The writ petition is accordingly disposed of.
