Learned counsel for the petitioner submits that the petitioner seeks for transfer of C
.T. Case No. 296 of 2014 from the Court of learned J.M.F.C., Athagarh to the Court of learned
S.D.J.M., Kamakshya Nagar. The main ground which has been taken by the learned counsel for the
petitioner is that the petitioner is now residing at her fathers place and there is danger to
her life at Athagarh and the Court at Athagarh is at a distance of about 60 Kms. away from th
e place of petitioner and therefore, the case should be transferred.
Considering the submissions of the learned counsel for the petitioner, I do not find a
ny good ground to transfer the case from the Court of learned J.M.F.C., Athagarh to the Court
of learned S.D.J.M., Kamakshya Nagar.
Since the petitioner has alleged that there is danger to her life at Athagarh, it is d
irected that if the petitioner or any of the prosecution witnesses on receipt of summons from
the learned Trial Court, approaches the Inspector in charge, Athagarh Police Station for provi
ding necessary protection to attend the Court at Athagarh, the Inspector in charge shall provi
de necessary protection to the petitioner and to the prosecution witnesses so that they can gi
ve their evidence in a free environment.
