Heard learned counsel for the petitioner and Mr. B.P. Pradhan, learned Addl. Government
Advocate for the State.
The petitioner files this application seeking for a direction to refund the Security Dep
osit and to make payment of the final bill with 18% interest per annum from the date of paymen
t accrues after the completion of final work and also seeks ancillary relief in the writ appli
cation.
Learned counsel for the petitioner submits that pursuant to the work allotted to the pet
itioner, he has executed the work but no final bill has been paid to him nor the security amou
nt has been refunded.
Mr. B.P. Pradhan, learned Addl. Government Advocate submits that this matter is arising
out of purely contractual matter and this matter cannot be adjudicated by this Court.
Considering the contention raised by learned counsel for the parties and without express
ing any opinion on the merits of the case, since the petitioner has not been refunded the secu
rity amount pursuant to the work already done as per the agreement between the parties, libert
y is granted to him to approach the appropriate forum ventilating his grievance.
With such liberty, the writ application stands disposed of.
