02. 14.12.2016 The petitioner having been implicated in Balichandrapu
r P.S. Case No.88 of 2016 corresponding to G.R. Case No.450 of 2016 registered for alleged
commission of offence under sections 448/294/323/324/325/326/307/506/34, I.P.C. pending in the
Court of the learned J.M.F.C., Chandikhole has filed this application for grant of bail in th
e event of his arrest in the said case.
Learned counsel for the petitioner submits that the parties are having long st
anding dispute relating to landed property and the allegation in respect of alleged commissio
n of offence under sections 326/307, I.P.C. are not against this petitioner whose role in the
incident has been differently alleged.
Learned Additional Government Advocate opposes the move.
Considering the submissions, in view of the nature of accusations and other su
rrounding circumstances of the case, in the absence of any other impediment, it is directed th
at in the event the petitioner surrenders before the court in seisin of the above mentioned ca
se within fifteen days and moves for bail, he be released on bail with such terms and conditio
ns as would be deemed just and proper by the said court with further condition that he will co
operate with the investigation.
The ABLAPL is accordingly disposed of.
