11.11.2016 Heard learned counsel for the petitioners and learned Addl. Standing C
ounsel.
The petitioners are apprehending arrest for the alleged commission of
offence under Sections 498-A, 506/34 of the IPC read with Section 4 of the D.P. Act in C.T. Ca
se No.4366/2016 of the court of learned SDJM, Bhubaneswar, arising out of Badagada P.S. Case N
o.265/2016.
The petitioners are permanent residents of Plot No.4293, Pandav Nagar,
P.S.Badagada, Dist. Khurda, which precludes any chance of their absconding from Justice. The
re is no allegation on behalf of the prosecution that the petitioners will tamper with the pro
secution evidence, if they are released on bail. Hence, the ABLAPL is allowed.
In the event of arrest of the petitioners in the aforesaid case, they
shall be released on bail by the arresting officer on such terms and conditions as deemed just
and proper by him.
The ABLAPL is disposed of.
