gilance Department.

 The petitioner is apprehending arrest for the alleged commission of offences under Sec
tions 420 and 120-B of the I.P.C. and Section 13(2) read with 13(1)(d) of the Prevention of Co
rruption Act in G.R. Case No. 04 of 2011(V) of the court of the Special Judge (Vigilance), Bha
wanipatna, arising out of Koraput Vigilance P.S. Case No. 49 of 2011.

 It is stated by the learned Addl. Standing Counsel for the Vigilance Department that c
harge-sheet has been submitted in the meantime against the petitioner without arresting the pe
titioner. In other words, the charge-sheet has been filed without showing him as absconder.
 In such event, there is no subsisting apprehension of arrest by the Investigating Offi
cer. Generally in such case, the Vigilance Judge issues summons. So, the application for antic
ipatory bail has become infructuous and is accordingly disposed of.
