The petitioner is apprehending arrest for the alleged commission of of
fence under Sections 468, 471/34 of the IPC in C.T. Case No.513/2007 of the court of learned S
DJM, Bargarh, arising out of Bargarh P.S. Case No.164/2007.
The co-accused has been admitted to anticipatory bail. None of the of
fences is punishable with terms of imprisonment exceeding seven years. No criminal antecedent
is reported against the petitioner. The petitioner is a permanent resident of Gurudwarda Chowk
, P.S./Dist. Bargarh, which precludes any chance of his absconding from justice. There is no
allegation on behalf of the prosecution that the petitioner will tamper with the prosecution e
vidence, if he is released on bail. Hence, the ABLAPL is allowed.
In the event of arrest of the petitioner in the aforesaid case, he sha
ll be released on bail by the arresting officer on such terms and conditions as deemed just an
d proper by him.
The ABLAPLs are disposed of.
