It is alleged that during the process of quarrel between the informant and his wife an
d the petitioners, petitioner no.4-Maheswar has given four blows by means of an axe on the hea
d of the informant. But it is apparent from the records that only one injury was found on the
head of the injured, which is simple in nature. Other injuries sustained by the injured are al
so simple in nature. No criminal antecedents are reported against the petitioners.
Keeping in view the aforesaid consideration, facts of the case and the fact that the p
etitioners are permanent residents of Village-Nuapali (Tekasar), P.S. Loisinga, Dist. Bolangir
and there is no reasonable apprehension of their absconding from justice, the application for
anticipatory bail is allowed. Moreover, there is no allegation that the petitioners shall tam
per with the prosecution evidence, if they are released on bail. It is directed that on the ev
ent of arrest, the petitioners shall be released on bail on such terms and conditions as deeme
d just and proper by the Arresting Officer.
