2. This is the third journey of the petitioner to this Court. The petitioner was working as a
DLR Clerk in the office of the Executive Engineer, Rural Works Odisha, opposite party no.3. H
e filed a writ petition being W.P.(C) No.5107/2014 which was disposed of on 8.5.2014 giving di
rection to opposite party no.3 to consider the case of the petitioner for the Work-charge Esta
blishment as it is seen that some of the juniors engaged after him has already been taken t
o the Work-charge Establishment. This Court had further directed that opposite party no.3 shal
l take a decision within a period of two months from the date of communication of that order.
As opposite party no.3, who is also opposite party no.3 in this writ petition, adopted dilly-d
ally tactics in not taking any action thereon, the petitioner filed a Contempt Petition being
CONTC No.957/2014, which was disposed of on 2.2.2016. While disposing of the Contempt Petiti
on a Bench of this Court held that the case of the petitioner has already been considered and
no corroborative documents are found regarding engagement of the applicant prior to 12.4.1993.
His prayer for brining his service under Work-charge Establishment being devoid of any merit
. Considering the contentions raised by the learned counsel, the aforesaid Bench of this Cour
t held that the order of this Court has already been complied with. If the petitioner is aggri
eved by dismissal of the order, he is at liberty to approach the appropriate forum. Thereafter
, the petitioner made a representation on 4.4.2016 to opposite party no.3 as at Annexure-4.
3. It is apparent that the petitioner has not approached the
