The petitioners happen to be the Agents of Gainmax Sales & Marketing Pvt. Ltd. It is
alleged that the Company accepted deposits to the tune of Rs.70,00,000/- and the persons in he
lm of affairs have absconded. It is borne out from the records that the petitioners have been
depositing the cash in the Bank, which they have received from the different depositors. None
of the offences under Sections 420, 406 and 120-B of the I.P.C. is punishable with terms of p
unishment exceeding seven years. No criminal antecedents are reported against the petitioners.
Keeping in view the aforesaid consideration, facts of the case and the fact that the p
etitioners are permanent residents of Village- Gunupur, P.S. Gunupur, Dist. Rayagada and there
is no reasonable apprehension of their absconding from justice, the application for anticipat
ory bail is allowed. Moreover, there is no allegation that the petitioners shall tamper with t
he prosecution evidence, if they are released on bail. It is directed that on the event of arr
est, the petitioners shall be released on bail on such terms and conditions as deemed just and
proper by the Arresting Officer.
