14.10.2015 Heard learned counsel for the petitioner and learned Standing Counsel for State.

2. This application has been filed by the petitioner challenging the inaction of the poli
ce in not apprehending the accused persons in connection with Gurudijhatia P.S Case No.50 of 2
015 corresponding to G.R Case No.290 of 2015 pending in the court of learned S.D.J.M., Athagar
h. The alleged offences are under Sections 302 / 34 of I.P.C read with Sections 25 and 27 of
Arms Act, 1959.

3. On instruction learned Standing Counsel for State submitted that in the meanwhile the
principal accused namely Rajib Lochan Das opposite party no.4 and two other accused persons n
amely Jitu Parida and Amiya Mohanty have been arrested and forwarded to custody. However, the
name of Biswajit Rout opposite party no.5 and Dillip Das opposite party no.6 has not been re
flected in the F.I.R. Due to disturbance between two groups, report and counter report were su
bmitted at Gurudijhatia P.S. for which Station Diary Entry No.179 dated 09.3.2015 was made. In
vestigation is under progress.

4. In view of the above, this Court disposes of this CRLMP with a direction that after co
mpletion of investigation the Inspector-in-Charge, Gurudijhatia P.S opposite party no.3 shall
 take consequential steps in accordance with law.
