 Petitioner has filed this application under Section 482 Cr.P.C. challenging th
e order dated 4.4.2009 passed by the learned S.D.J.M., Kendrapara in connection with G.R. Case
 No. 962 of 2000 issuing N.B.W. against the petitioner. The offence alleged against the petiti
oner is under Section 47(a) of Bihar and Orissa Excise Act.

 Learned counsel for the petitioner submits that earlier petitioner was release
d on bail and due to non-appearance of the petitioner before the court below on 4.4.2009, N.B.
W. was issued against him. He further submits that petitioner was not aware about the posting
of the case due to gap of communication. He is ready and willing to abide by any terms and con
ditions imposed by the court and to appear before the court as and when required.

 Considering the aforesaid submissions, this Court directs that in case the pet
itioner surrenders within a period of two weeks from today in connection with G.R. Case No. 96
2 of 2000 before the learned S.D.J.M., Kendrapara and moves for bail in such event he shall be
 released on bail on such terms and conditions as
deemed fit and proper with an undertaking that as and
when required he shall appear before the court. Petitioner
shall cooperate for early conclusion of the trial.

The Criminal Misc. Case is disposed of.
