19.11.2015 Heard learned counsel for the petitioner and learned Additional Standing Counsel.
The petitioner is implicated in offence punishable under Sections 376 (I), I.P.C. an
d other allied offences.
Learned counsel for the petitioner submits that, F.I.R. has come to be lodged agains
t the petitioner out of the instinct of self-preservation of the victim when the act of coitus
between the victim and the petitioner was seen by her mother-in-law.
The case is stated to have been committed to the Court of Sessions in the meantime.
Considered the materials placed by learned counsels for the parties.
Taking into consideration the facts and submission, circumstances involved, factum o
f permanent residence of the petitioner and the stage of the proceeding, it is directed that t
he petitioner shall be released on bail by the learned Additional Sessions Judge, Talcher in C
.T. (S) Case No.67 of 2015 on such terms and conditions as deemed just and proper.
The BLAPL is accordingly disposed of.
