19.11.2015 Heard learned counsel for the petitioner and learned Additional Standing Counsel.
The petitioner is implicated in offence punishable under Sections 366-A, I.P.C. and
other allied offences.
One Jaga Mallik is alleged to have kidnapped the victim girl, who has not yet been t
raced, with the assistance of the present petitioner and one Guna Pradhan. The present petiti
oner is stated to be a co-villager of the victim girl. Jaga Mallik and Guna Pradhan have not
yet been arrested by police and preliminary charge-sheet has been filed against the present pe
titioner, keeping the investigation open.
Considered the materials placed by learned counsels for the parties.
Taking into consideration the facts and submission, factum of permanent residence of
the petitioner, nature of allegation against him and completion of investigation in the meant
ime as against the present petitioner, it is directed that the petitioner shall be released on
bail by the learned J.M.F.C., Pattamundai in G.R. Case No.243 of 2015 on such terms and condi
tions as deemed just and proper.
The BLAPL is accordingly disposed of.
