The petitioner is apprehending arrest for the alleged commission of offence un
der Sections 147, 148, 294, 323, 452, 354 and 307/149 of the IPC in G.R. Case No.524 of 2008 o
f the court of learned S.D.J.M., Banai, Sundargarh, arising out of Koida P.S. Case No.83 of 20
08.
The petitioner has not been named in the FIR. He was about 18 years age at the
time of occurrence. It is submitted that charge-sheet has been filed in the meantime.
Keeping in view the nature of allegations and the facts of the case, applicati
on for anticipatory bail is allowed. Let the petitioner surrender before the learned S.D.J.M.,
Banai in the aforesaid case within 21 days and pray for bail. On such event, he shall be rele
ased on bail on such terms and conditions as deemed just and proper by the learned Magistrate.
In case, he is arrested by the police in the meantime, the accused shall be produced before t
he learned Magistrate within 24 hours and the learned Magistrate shall grant him bail as direc
ted above.
The ABLAPL is disposed of accordingly.
