09.12.2015 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are accused in G.R.Case No. 740 of 2015 pending on the file of
learned S.D.J.M.,Padampur registered under Sections 341/ 294/ 323/506/354/ 354-A/34, I.P.C.an
d section 3(i)(x) of SC & ST (PA) Act.
It is submitted on behalf of the petitioners that there is a counter case filed by the
present petitioners and dispute related to borrowing of some money and non-payment of the sam
e. It is further submitted that the allegations as made in the FIR, do not make out an offence
under Section 3(i)(x) of SC & ST (PA) Act.
Considering the submissions, it is directed that the petitioners on surrender
before the learned S.D.J.M.,Padampur in the aforesaid case, shall be released on bail on execu
ting bond of Rs.10,000/- ( rupees ten thousand) each with one surety for the like amount to t
he satisfaction of the said Court with the conditions that they shall appear before the Inves
tigating Officer as and when required for the purpose of investigation and shall not involve t
hemselves in any act of the alleged type.
The ABLAPL is accordingly disposed of.
