By this Appeal filed under Section of the 16 of National Green Tribunal Act, 2010 the appellant has challenged the show cause notice dated 21.05.2025 issued by Delhi Pollution Control Committee (DPCC) for levy of environmental compensation of Rs. 10 lakhs.

The appellant has also challenged the order dated 17.07.2025 passed by DPCC imposing the environmental compensation of Rs. 10 lakhs.

There is a delay in filing the appeal, therefore, IA No.557/2025 has been filed by the appellant seeking condonation of delay.

Affidavit dated 20.11.2025 has been separately filed in support of the application for condonation of delay.

Having heard the Learned Counsel for the parties and perusal of the record, it is noticed that no proper explanation has been furnished by the

appellant explaining the delay in challenging the show cause noticed dated 21.05.2025.

That apart, once the order passed in pursuance to the show cause notice is under challenge, there may not be necessity to challenge the show cause notice.

Appellant could not satisfy the Tribunal that challenge to the show cause notice has been raised within the condonable period provided in the proviso to Section 16 of the National Green Tribunal Act, 2010. Even otherwise, multiple orders/notices in the same appeal cannot be challenged. Hence, challenge to the show cause notice dated 21.05.2025 in this appeal is rejected.

The appellant has also challenged the order dated 17.07.2025 passed by DPCC levying the environmental compensation. This appeal has been filed on 13.08.2025. The appeal is within the time as against the order dated 17.07.2025, hence, it is entertained against the said order. IA No. 557/2025 is accordingly disposed of.

Respondents are granted four weeks’ time to file reply to the appeal.

Respondent no.1-DPCC is directed to produce the original record leading to passing of the impugned order at the time of hearing of the appeal.
