ORDER
1. The advance hearing application [I.A. No. 12 of 2026 (SZ)] is allowed and the matter is taken up today for consideration.
2. This interlocutory application [I.A. No. 11 of 2026 (SZ)] has been filed seeking clarification of the order dated 12.01.2026 to the effect that the applicant be put on notice of the inspection and be permitted to remain present during the inspection by the authorities. It is stated in the application that the Central Pollution Control Board (CPCB) intends to visit the site on 12.02.2026 and 13.02.2026.
3. The CPCB was impleaded as an additional respondent on the previous occasion and the above direction was issued to inspect the site and submit a technical status report, considering the gravity of the issue.
4. The clarification now sought is to permit the applicant to remain present during the inspection. The applicant appears to be aware of the proposed dates of inspection. The order dated 12.01.2026 does not specifically prohibit or prevent the applicant from being present at the time of inspection.
5. Therefore, no clarification is required, as there is no ambiguity in the order dated 12.01.2026. It is merely the apprehension of the applicant that he may not be permitted to be present during the visit. As the order is clear and requires no clarification, the interlocutory application [I.A. No. 11 of 2026 (SZ)] is closed.
