In this original application, Applicant has raised the grievance against the illegal and unauthorised colony, namely, New Aruna Nagar in Zone 'O'.

It has been pointed out that the Writ Petition No. 5751/2014 in the matter of Vijay Kumar Diwakar vs. South Delhi Municipal Corporation & Ors. in respect of the removal of unauthorised encroachment and illegal colonies from Zone 'O' is already pending before the Delhi High Court.

In view of the judgment of the Hon'ble Supreme Court in Civil Appeal Nos. 5348-5349/2019 in the matter of The State of Himachal Pradesh & Ors. vs. Yogendera Mohan Sengupta & Anr., reported in (2024) 1 S.C.R. 973: 2024 INSC 3 , it would not be proper to continue with the parallel proceedings before the Tribunal on the same issue.

The Applicant has raised an incidental issue of discharge of untreated sewage from these colonies. This issue is already under consideration in OA No. 190/2024. Hence, we permit the Applicant to file an appropriate application for intervention in that OA and place his stand.

In view of the above, no further order in this OA is required which is accordingly disposed of. Pending I.A’s, if any, also stand disposed of.
