In this Original Application (OA), the Applicant has raised a grievance against proposed operation of solid waste management system established by the Gram Panchayat at village Kharkhara, Block Dharuhera, District Rewari, Haryana.

Learned counsel for the Applicant submits that the solid waste segregation centre is being set up near a college, school, power house but he could not point out any siting criteria which has been violated while setting up the said solid waste segregation centre.

Learned counsel for the applicant has referred to the Rule 8 of the Solid Waste Management Rules, 2026 but the Rule 8 also does not provide for any siting criteria. He has placed reliance upon the google earth images filed as Annexure A-1 but unless the siting criteria of Rule prescribing the distance from the college or power house etc. is pointed out it cannot be held that the siting criteria in setting up the solid waste segregation centre is violated.

Since the Applicant has failed to show any prima facie material indicating violation of the environmental norms or Rules or Regulations concerning setting up of the solid waste segregation centre, no case is made out to entertain this OA. The solid waste segregation centres are necessary for proper management of the solid waste.

Hence, in such circumstances, we find no ground to entertain the OA which is accordingly dismissed.
