In this original application, the Sarpanch of Gram Panchayat, Village Rampur Kalan, District SAS Nagar, Mohali, Punjab alongwith two other Applicants has raised the grievance that the Respondent No. 8, M/s Sharon Resorts regularly hosts commercial events such as weddings, parties, receptions and corporate functions. These events are often conducted with the use of high-decibel sound systems, DJ music, and loudspeakers, usually extending to early hours of the morning upto 2:00 to 3:00 AM. The Applicant alleges that the Respondent No. 8 has indulged in these activities without obtaining the requisite permission from the competent authority and disregarding the norms relating to noise pollution as has been laid down.

Learned Counsel for the Applicant submits though the complaint dated 25.03.2025 was made to the Chairman, Punjab Pollution Control Board (PPCB), but no action on the said complaint has been taken till now.

Having regard to the nature of grievance which has been raised by the Applicant, we are of the view that the spot inspection is required to be carried out by the concerned authority when the event is in progress. The said exercise requires ground verification which can more appropriately be done and the requisite action as provided in law can be taken, in case, if the violation of environmental norms is found, by the Respondent No. 2, Chairman, PPCB. A complaint has already been made to the Respondent No. 2, but the grievance is that the needful has not been done. The action on the complaint is required.

Thus, we dispose of the OA directing the Respondent No. 2 to duly consider the complaint of the Applicant dated 25.03.2025, carry out the spot inspection when the event in the premises of Respondent No. 8 is in progress, ascertain if there is any violation of environmental norms, especially the norms relating to noise pollution and take appropriate remedial and punitive action. Let this exercise be completed by Respondent No. 2 within a period of three months from the date of receipt of a copy of this order.
