This original application is registered suo motu on the basis of the news item titled "It’s waste that flows in Coimbatore’s Sanganoor canal" appearing in the Times of India dated 21.06.2025.

The news item relates to the ongoing environmental violations in Coimbatore’s Sanganoor canal, which has become heavily polluted despite recent desilting efforts. As per the article, although the city corporation recently spent ₹40 lakh to desilt 10 km of the canal as part of monsoon preparedness, the canal already appears neglected and choked with waste. The article highlights that people continue to dump old mattresses, cots, sofas, carton boxes, thermocols and used electronic gadgets into the canal. The article mentions that unchecked red soil mining and growth of brick kilns in Thadagam area has reduced the inflow of water in the canal. As per the article, people are encroaching the canal bund and dumping all sorts of waste in the canal. The article also mentions that door to door collection does not include scrap material which eventually ends up going to the canal.

The above matter indicates violation of the Solid Waste Management Rules, 2016; the Water (Prevention and Control of Pollution) Act, 1974 and the Environment (Protection) Act, 1986.

Power of the Tribunal to take up the matter suo-motu has been recognized by the Hon’ble Supreme Court in the matter of “Municipal Corporation of Greater Mumbai vs. Ankita Sinha & Ors.” reported in 2021 SCC Online SC 897 .

Hence, we implead the following as respondents in the matter:

(2). Tamil Nadu Pollution Control Board, through its Member Secretary, Tamil Nadu Pollution Control Board 76, Mount Salai, Guindy, Chennai - 600 032.

(3). District Magistrate, Coimbatore Collectorate Building, Coimbatore- 641018

(4). Coimbatore City Municipal Corporation, through its Commissioner, Corporation of Coimbatore, Coimbatore - 641001, Tamil Nadu.

Issue notice to the above respondents for filing their response/reply by way of affidavit before the Southern Zonal Bench of the Tribunal at least one week before the next date of hearing. If any respondent directly files the reply without routing it through his advocate, then the said respondent will remain virtually present to assist the Tribunal.

Since the matter falls within the jurisdiction of Southern Zonal Bench of the Tribunal, therefore, the OA is transferred to the Southern Zonal Bench, Chennai for appropriate further action. Let the original record of the OA be transferred to Southern Zonal Bench, Chennai.
