Applicants- Madasir Hasan, Kashif Alam, Rajman Sonkar, Dr. Ramji Dubey, Jiya Kamar, Mohd. Rafi and Dr. Mumtaj Ahmad made a complaint dated 09.08.2021 on Public Grievance Portal of this Tribunal regarding domestic sewage collecting in a pit overflowing to their residences and residences of others causing pollution and health hazards.

Vide order dated 06.03.2024 this Tribunal disposed of the application by constituting a Joint Committee and directing the same to jointly inspect the area, collect relevant information and take appropriate 1

action for remediation and rejuvenation so that alleged pollution may be removed and to file a report before Ld. Registrar General of this Tribunal who was given liberty to place the matter before the Bench if considered necessary.

In compliance thereof report was filed by the District Magistrate, Azamgarh vide email dated 03.05.2024.

Finding further orders to be necessary, the matter was placed before the Bench.

Vide order dated 01.07.2024, concerned authorities were impleaded as respondents no. 1 to 5.

In the course of hearing, reports/replies were filed by the concerned authorities.

Lastly, report dated 05.05.2025 has been filed by U.P. Jal Nigam vide email dated 14.05.2025. The relevant part of the report reads as under:-

“5. That it is submitted that the installation of the sewer line and the provision of sewer house connections for a total of 70 households in Mohalla Jalandhari have been entirely completed. All the proposed sewer house connections under the AMRUT 1.0 project have been successfully executed, ensuring that each of the 2,953 sewer house connections are now connected to the sewer system.

6. That the construction of the 8 MLD STP has been duly completed by the Jal Nigam (Urban), Azamgarh. The trial run of the STP has been concluded successfully and the STP is currently fully operational. The wastewater generated from Mohalla Jalandhari and other wards of the Nagar Palika Parishad, Azamgarh is being carried through the sewer network to the 8 MLD STP, where it is duly being treated and discharged.

A copy of photographs of the STP are annexed herewith and marked as ANNEXURE-2 .

7. That at present, the STP is receiving approximately 5.00 to 5.50 MLD (Million Litres per Day) of sewage, which is in line with the design capacity of 6 MLD for the base year. The STP has been

designed with an 8 MLD capacity for the year 2035. That as per the samples collected by the UPPCB, Azamgarh and the analysis report dated 05.03.2025 of the same, the treated water being discharged from the STP is complying with the norms. A copy of the analysis report dated 05.03.2025 is annexed herewith and marked as ANNEXURE-3 .

8. That it is humbly submitted that the Jal Nigam (Urban), Azamgarh has fully complied with the directions issued by the Hon'ble Tribunal. Furthermore, Consolidated Consent to Operate and Authorization (CCA) dated 16.04.2025 has been granted by the UPPCB for the operation of the STP.

A copy of CCA dated 16.04.2025 is annexed herewith and marked as ANNEXURE-4 ”

Reference has been made by learned counsel for respondent no. 3 to affidavit dated 01.10.2024 of the Executive Officer, Nagar Palika Parishad, Azamgarh and affidavits of Firoz Ahmed, Sohrab, Mukhtar Ahmad, Abdul Jabbar Qureshi and Aftab Alam filed alongwith the same regarding proper discharge of domestic sewage in the newly constructed drain.

In the course of hearing Applicant no.1 - Madasir Hasan has joined the proceedings through mobile phone call and he has submitted that the grievances raised by them in the complaint have been redressed.

In view of submissions made in the replies/reports/affidavits filed and also statement made by Applicant no. 1-Madasir Hasan, no further action is required to be taken on the present miscellaneous application which is disposed of accordingly.
