After hearing of the arguments and reserving of the case for judgment/order, the original applicant has filed I.A. No. 452/2025 for reopening of the original application no. 124/2024 for further hearing and adjudication in light of the subsequent facts and possible perjury committed by respondent no. 5 and I.A. No. 453/2025 for issuance of direction to respondents particularly respondent no. 5 and the District

Administration, to maintain status quo and not to undertaken any tree felling or related activity on the and in question till further orders.

Pursuant to mentioning by Learned Counsel for the original applicant, both the above said I.As. have been listed today for hearing.

Learned Counsel for the original applicant has made statement seeking dismissal of I.A. No. 452/2025 as withdrawn.

I.A. No. 452/2025 is accordingly dismissed as withdrawn.

In the course of hearing Learned Counsel for the original applicant has referred to order dated 20.04.2012 passed by Hon’ble Supreme Court of India in SLP (Civil) No. 14692 of 2010 titled Pawan Kumar and others vs. State of Haryana and others for maintaining of status quo and submitted that in violation thereof the Deputy Commissioner, Rohtak has, vide order dated 21.06.2025, directed SDO, HSVP for the purpose of counting of the trees despite the fact that as per affidavit filed by respondent no. 5, 968 trees were identified for felling. Respondent no. 5 has asked Haryana Forest Development Corporation to expedite the process of execution of the agreement for cutting of trees. The Estate Officer, HSVP, Rohtak has issued letter dated 18.06.2025 for handing over physical possession of plots to the aggrieved allotees. The respondents may be directed to maintain status quo and not to undertake any tree felling or related activity on the land in question till further orders.

The stand of learned Counsel for the original applicant is that for maintaining of status quo has already been passed by the Hon’ble Supreme Court of India in the above mentioned SLP which is stated to be binding on the parties. In view of this very stand of the learned Counsel for the original applicant, we consider it unnecessary to pass any separate order for maintenance of status quo as prayed for.

Even otherwise, the original applicant had filed I.A. No. 291/2025 for directing the respondents to maintain complete status quo in respect of the subject land and to refrain from taking any action which may lead to the felling of trees or altering the ecological character of the land as expressly observed by the Hon’ble Supreme Court of India in order dated 24.05.2010 titled as Pawan Kumar and others vs. State of Haryana and others and for directing that no possession shall be handed over to the allottees in furtherance of the modified order of the Hon’ble Supreme Court until due verification is conducted regarding compliance with the status quo directions. On 09.05.2025 this Tribunal reserved orders on the original application as well as above mentioned I.A.

Similar prayer has been made in I.A. No. 453/2025 which shall also abide by order to be passed by this Tribunal on the original application and I.A. No. 291/2025 and passing of the order is not likely to take very long time as pronouncement of the order can be expedited and it is so ordered accordingly.
