Mr. Pushpender resident of Village Berni, Post Bemra, Shankargadh, Tehsil Bara, District Prayagraj, Uttar Pradesh had sent to this Tribunal a letter petition by email, which was treated and registered as Original Application no. 617/2022.

The applicant raised the grievance about causing of air and water pollution by M/s Tata Company and M/s Ultratech Company in village Berni, Tehsil Bara, District Prayagraj, Uttar Pradesh.

The above said O.A was disposed of by this Tribunal vide Judgment dated 22.05.2024. Since compliance reports were not submitted, the matter was listed before Bench for further orders.

Additional affidavits dated 08.04.2025 and 19.05.2025 were filed by respondent no. 3-DM, Prayagraj, additional affidavits dated 29.01.2025 and 12.02.2025 were filed by respondent no. 4- PPGCL and additional affidavit dated 17.02.2025 was filed by respondent no. 5-UTCL and report of the Joint Committee was filed vide email dated 20.02.2025.

In the Joint Committee Report dated 16.05.2025 filed by the District Magistrate, Prayagraj vide affidavit dated 19.05.2025 it has been mentioned that respondent no. 4 has developed green belt in land measuring 451.944 acres which is 30.79 percent of total plant area 1468 acres while respondent no. 5 has setup green belt in 5.99 hectares which is 29.95 percent of total plant area of 20 hectares.

Learned Counsel for respondents no. 4 and 5 have submitted that respondents no. 4 and 5 will take remedial steps for further remedial plantation to comply with EC condition of creation of green belt over land equivalent to 33 percent of the Project area.

Respondents no. 4 and 5 are directed to take further action and carrying out further plantation to comply with EC condition.

Respondents no. 4 and 5 are also directed to file action taken report before this Tribunal within three months with copy to the District Magistrate, Prayagraj who shall take appropriate steps for due verification of the same within next one month and file verification report before Learned Registrar General of this Tribunal within next one month.
