The Applicant-Islam had sent a letter petition to this Tribunal which

was registered as O.A. No. 789/2024.

The applicant raised the grievances about running of a marriage palace by Ajaj S/o of Munna illegally in violation of environmental norms and causing of noise and air pollution due to fireworks, operation of DJ in the night and dumping of solid and liquid waste emitting foul smell.

The above said original application was disposed of vide order dated 12.08.2024 whereby this Tribunal constituted a Joint Committee and directed the same to take appropriate remedial and punitive action in accordance with law against the violator(s) and submit its report within

two months before Ld. Registrar General of this Tribunal who was given liberty to place the matter before the Bench for further orders if necessary.

In compliance thereof report dated 26.10.2024 was filed by District Magistrate, Ghaziabad vide email dated 26.10.2024. The relevant part of the report is reproduced below:-

"Inspection of Marriage Home with respect to order passed on 12.08.2024 by Hon'ble National Green Tribunal, New Delhi in ОА по. 789/2024 in the matter of Islam Vs State of Uttar Pradesh. X X X X

2. Compliance:-

In compliance to aforesaid direction inspection of Marriage Home was carried out by joint team comprising officials from District Magistrate, Ghaziabad, Regional Office, Uttar Pradesh Pollution Control Board, Ghaziabad and Nagar Nigam, Ghaziabad on 22.10.2024. During inspection observation made as follows:-

1. During inspection it was observed that the Marriage Home in question is situated in the name of M/s Navab Malik Marriage Home proprietor Shri Javed Malik at Dari factory Mohalla toli tehsil Loni, Ghaziabad within the area of Nagar Palika Parishad Loni, Ghaziabad.

2. During inspection Shri Ajaj S/o of Munna, resident of Mohalla Toli, tehsil loni, District Ghaziabad was present and it was reported that no booking have been made since last 06 months. During visit no events/function were being carried out by the marriage home.

3. During inspection it was reported by Shri Ajaj S/o Munna that he was employed in said marriage home and left the job since last 06 months and not engaged with marriage home. In this regard notarized affidavit dated 22.10.2024 is attached here with as Annexure-I.

4. During inspection joint team observed that the maintenance of marriage home is in poor condition and presently not in operational condition. During visit video recording of Marriage Home also done and the pen drive is attached herewith as Annexure-II.

5. During visit dumping of solid/liquid waste was not found near by the Marriage Home.

6. Further it is also pertinent to mention here that in the same matter О.А. Nо. 74/2024 Islam Vs State of U.P. & ors was filed before Hon’ble National Green Tribunal, New Delhi and in compliance of order passed on 02.05.2024 detailed response by UPPCB has been filed on dated

01.08.2024 and the copy of same is attached here with as AnnexureIII.

3. Conclusion:-

During inspection joint team observed that prima-facie the marriage home in question is not in operative condition and presently no events/function is being carried out. Photograph taken during visit given below:-

In view of the deficiencies in the report and considering further orders to be necessary the Registry has listed the matter before the Bench by treating and registering the report received as M.A. No. 37/2025.

In view of the averments made in the original application and the report submitted, the Tribunal considered it appropriate to seek response from (i) State of Uttar Pradesh through the District Magistrate, Ghaziabad, (ii) Uttar Pradesh Pollution Control Board (UPPCB) and (iii) M/s Navab Malik Marriage Home through proprietor Shri Javed Malik at Dari factory Mohalla Toli Tehsil Loni, Ghaziabad who were impleaded as respondents no. 1 to 3 vide order dated 07.04.2025.

In response to order dated 07.04.2025, response dated 15.05.2025 has been filed by respondent no. 1-District Magistrate, Ghaziabad vide email dated 17.07.2025. Relevant part of the report read as under:-

“5. That pursuant to the aforesaid direction of the Hon'ble Tribunal, inspection of said Marriage Home was carried out on dated 22.10.2024 and an action taken report dt. 22.10.2024 has already been filed by the Deponent stating that the marriage home in question is not in operative condition and presently no events/ function is being carried out. That the said inspection report has already been filed before this Hon'ble Tribunal.

6. That, above captioned matter was last listed for hearing on 07.04.2025 before Hon'ble National Green Tribunal, wherein the Hon'ble Tribunal directed as under:

".......6 In view of the averments made in the original application and the report submitted, we consider it appropriate to seek response from (i) State of Uttar Pradesh through the District

Magistrate, Ghaziabad, (ii) Uttar Pradesh Pollution Control Board UPPCB and (iii) M/s Navab Malik marriage Home through proprietor Shri.Javed Malik at Dari factory Mohalla Toli Tehsil Loni, Ghaziabad who are impleaded as respondents no. 1 to 3.

7. The Registry is directed to prepare and attach memo of parties to the miscellaneous application and issue notices to respondents no. 1 to 3 requiring them to file their reply/response within one month.

8. Notice be served on M/s Navab Malik Marriage Home through the District Magistrate, Ghaziabad and for this purpose notice issued to the Project Proponent be sent to the District Magistrate, Ghaziabad by E-mail for getting service of the same effected on the Project Proponent and sending his report in this regard to this Tribunal.......”

7. That in compliance of the aforementioned directions of this Hon'ble Tribunal, the notice has duly been served to the Project Proponent and a Proof of Service has already been filed before this Hon'ble Tribunal.

8. That furthermore, the UPPCB, Ghaziabad has written a letter dt. 22.04.2025 to M/s Nawab Malik Marriage Home, Dari Factory, Mohalla Toli, Tehsil Loni, Ghaziabad. That vide the said letter it has been directed to the Project Proponent to provide information regarding bookings at the said Marriage Home, so that noise monitoring may be carried out. Copy of the said letter is attached herewith as ANNEXURE A-1.

That the latest inspection of M/s Malik Marriage Home situated at Dari factory, Loni, Mohalla Toli, Loni Police Station, Ghaziabad was carried out on 03.05.2025 in presence of Shri Javed Malik Proprietor of Marriage Home. That during the said inspection no events/functions were being carried out by the Marriage Home and found to be closed completely.

Further during inspection owner of Marriage Home informed that no bookings have made since 28.05.2024 and the Marriage Home is completely stopped.

A Copy of the inspection report dt. 03.05.2025 has been annexed herewith as ANNEXURE A-2.

10. That, in response to the aforementioned letter dt. 22.04.2025, the Project Proponent has written a letter dated 05.05.2025 along with notarized affidavit stating that no bookings have made since 28.05.2024 till 05.05.2025 and the Marriage Home is completely closed.

Copy of the letter dt. 05.05.2025 is attached herewith as ANNEXURE A- 3.

11. That in view of above UPPCB vide letter dated 09.05.2025 issued direction to owner of Marriage Home that no wedding procession

should be conducted without obtaining necessary permissions from concerned authorities and also adhering the environmental regulations.

A Copy of the letter dt 09.05.2025 has been annexed herewith as ANNEXURE A-4.”

Response dated 15.05.2025 has also been filed by respondent no. 2- Uttar Pradesh Pollution Control Board vide email dated 17.07.2025. Relevant part of the response read as under:-

“7. That, in compliance to the above mentioned order dated 07.04.2025 UPPCB, Ghaziabad has written a letter dt. 22.04.2025 to M/s Nawab Malik Marriage Home, Dari Factory, Mohalla Toli, Tehsil Loni, Ghaziabad. That vide the said letter it has been directed to the Project Proponent to provide information regarding bookings at the said Marriage Home, so that noise monitoring may be carried out. Copy of the said letter is attached herewith as ANNEXURE A-1.

That the latest inspection of M/s Malik Marriage Home situated at Dari factory, Loni, Mohalla Toli, Loni Police Station, Ghaziabad was carried out on 03.05.2025 in presence of Shri Javed Malik Proprietor of Marriage Home. That during the said inspection no events/functions were being carried out by the Marriage Home and found to be closed completely. Further during inspection owner of Marriage Home informed that no bookings have made since 28.05.2024 and the Marriage Home is completely stopped.

10. That in view of above UPPCB vide letter dated 09.05.2025 issued direction to owner of Marriage Home that no wedding procession should be conducted without obtaining necessary permissions from concerned authorities and also adhering the environmental regulations.

None has appeared for the applicant and no objections to the reports filed before this Tribunal have been filed by the applicant or any other person.

We have heard learned Counsel for the respondents and gone through the material on record including the reports referred to above.

In view of the submissions made in the reports, no further action is required to be taken at this stage and the miscellaneous application is disposed of accordingly with directions to the District Magistrate, Ghaziabad and the Regional Officer, UPPCB, Ghaziabad to periodically inspect the site and take further preventive, punitive and remedial measures as may be required in accordance with law.

A copy of this order be sent to the District Magistrate, Ghaziabad and the Regional Officer, UPPCB, Ghaziabad by email for requisite compliance.
