Mr. Dipanjan Ghosh, learned counsel has filed Vakalatnama on behalf of the appellants and Mr. Ashok Prasad, learned counsel has filed Vakalatnama on behalf of the respondent which are taken on record.

I.A.No.83/2025/EZ has been filed by the appellants for condonation of 19 days’ delay in filing of the Appeal on the grounds that learned Advocate-on-Record for the appellants was suffering from acute uveitis from 14.03.2025 and could not contact the appellants till 04.04.2025 and after discussion on that date the appellants started preparing the appeal which was filed on 14.04.2025 with delay of 19 days’ and the delay in filing of the appeal for reasons beyond control of the appellants.

Learned counsel for the respondent has no objection, if the application for condonation of delay in filing of the appeal is allowed without prejudice to adjudication of rights of the respondent on merits.

In view of the reasons mentioned and also no objection by respondent, application for condonation of delay is allowed subject to all just exceptions and without prejudice to adjudication of rights of respondent on merits.

Counter affidavit dated 18.11.2025 has been filed by respondent which is taken on record.

List on 18.12.2025 for final hearing.

The respondent is directed to produce the original record for perusal with photostat copy thereof to be placed on record of the present appeal.
