I.A. No. 106/2025/EZ has been filed by Rakesh Kumar Jena and

Ranajeet Keshari Jena for their impleadment as co-petitioners.

The respondents are given opportunity to file reply to above

mentioned I.A. but no replies are to be filed. Learned counsels for the respondents have no objection if above mentioned I.A. is allowed.

106/2025/EZ is allowed and applicants- Rakesh Kumar Jena and

Ranajeet Keshari Jena are impleaded as co-applicants subject to the condition that the above said co-applicants will not be entitled to file any separate pleadings.

Affidavit dated 14.11.2025 has been filed by respondent no.13Director General of Mines Safety which is taken on record.

Affidavit dated 17.11.2025 has been filed by respondent no.11SEIAA Odisha which is taken on record.

Vide order dated 08.10.2025, the Joint Committee constituted by this Tribunal was directed to submit its report within one month. 7. However, the report of the Joint Committee has not been submitted till date. No request for extension of time has been made on behalf of the Joint Committee.

Default in submission of the report of the Joint Committee has caused inconvenience and unnecessary delay in disposal of the case and also resulted in unnecessary adjournment. In the facts and circumstances of the case, we are constrained to impose costs of Rs. 10,000/- on the Collector and District Magistrate, Jajpur, Odisha who is the nodal officer for co-ordination and compliance. Costs shall be deposited by the Collector and District Magistrate, Jajpur, Odisha within 15 days with Ld. Registrar of Eastern Zonal Bench of this Tribunal.

Report of the Joint Committee may be filed within four weeks. In case of failure to do so, the Collector and District Magistrate, Jajpur, Odisha shall appear before this Tribunal physically to explain the reasons for non-compliance.

Learned counsels for respondents no. 1 to 8, 10, 12, 14 and 15 seek six weeks’ time for filing of their responses.

Responses by respondents no. 1 to 8, 10, 12, 14 and 15 may be filed within six weeks positively.

Notice be issued again to respondent no. 9 requiring it to file its response within six weeks positively.
