The present petition has been filed by the complainant in Crl.M.P.No. 4431 of 2025, on the file of the Judicial Magistrate No.V, Madurai, seeking a direction as against the respondents to implement the order passed by the trial Court dated 11.07.2025 wherein, the respondents were directed to conduct preliminary enquiry and in case a prima facie case is made out proceed in accordance with law.

According to the learned Counsel for State of TN (Crl.Side) appearing for the third respondent, enquiry was conducted after issuing summons to the corporation officials and it was found that the petitioner has put up a petty shop without obtaining proper license from the Corporation and therefore, no criminal action can be initiated as against the officials or the person who lodged a complaint for removal of the petty shop. The third respondent has filed a report before the Judicial Magistrate No.V, Madurai on 30.06.2026.

3. According to the learned counsel appearing for the petitioner, the closure of the shop has been done without conducting any enquiry with the petitioner herein and she has not been provided with the copy of the closure report.

In view of the above said facts, there shall be a direction to the third respondent to provide a copy of the closure report to the petitioner and the petitioner would be entitled to agitate the same before the appropriate authority. The closure report shall be furnished to the petitioner within a period of two weeks from the date of receipt of a copy of this order.

5. With the above said observation, this Criminal Original petition is disposed of.
