2. With the consent of both sides i.e., Mr.Vignesh Raj, learned counsel for substituted petitioners and Mr.C.Selvaraj, learned State counsel, main writ petition is taken up. Owing to the trajectory the matter has taken, it is not necessary to dilate much on facts suffice to say that the petitioner was first appointed as a vocational instructor as he has possessed the qualification of Teachers Training Certificate, Agriculture (Higher Grade), but he did not possess the educational qualification prescribed in the then obtaining G.O.Ms.No.1719 dated 14.09.1978. As there was dearth of staff for teaching Agriculture subject, persons already working were allowed to continue by granting exemption from possessing required qualification for appointment. Thus the petitioner was allowed to continue from 1979 onwards notwithstanding the lesser qualification. In short, the most important factum necessary for disposal of captioned writ petition is, the writ petitioner was allowed to teach from 1979 onwards on a consolidated pay after having waived the educational qualification for appointment to the post of Vocational Instructor. When it came to pensionary benefits, the period for which the writ petitioner served as part time Vocational instructor i.e., from 30.06.1979 to 04.10.1996, was not taken into account, this was taken up by the writ petitioner, it culminated in second respondent making the impugned order. Assailing the impugned order, captioned writ petition has been filed.
