Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay all further proceedings pursuant to the judgment and decree dt.13/10/2017 in Os.No.92/2015 on the file of the II Additional District Court, Salem(in CMP.No.2410/2018) pending disposal of the above AS.No.90/2018.
Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.D.SHIVAKUMARAN, Advocate for the petitioner and of MR.S.KALYANARAMAN, ADVOCATE on behalf of the Respondents the court made the following order:-
In this miscellaneous petition, on 01.03.2018, this Court passed the following order :-
“There shall be a stay on passing of final decree. Pursuant to the preliminary decree, further proceedings can go on, except passing of final decree."
Thereafter, the matter has been kept pending till this date. Hence, the interim order already granted is made absolute and this petition is ordered accordingly.
