Writ Petition under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to complete the process of Certificate verification in a time bound manner and consequently, direct the 2^nd respondent to appoint the petitioner as Secondary Grade Teacher.

The petitioner has filed the present Writ Petition for the relief stated above.

The learned counsel for the petitioner submitted that the petitioner appeared for the Teacher Eligibility Test Exam conducted by the first respondent on 14.10.2012, subsequently, the petitioner secured 91 marks. The respondent called for the Certificate verification but the petitioner could not attend the Certificate Verification. Further, the

respondent gave a chance to those who did not attend the Certificate Verification, to come in person on 10.12.2012. The petitioner went to the first respondent office and submitted the Certificates with representation letter and the first respondent simply collected the Certificates and till now, they did not respond and reply but the respondent issued fresh notification for Teacher Eligibility Test. Hence, the present Writ Petition is filed by the petitioner.

Assailing the allegations made in the affidavit, the learned Government Advocate has filed a counter affidavit on behalf of the respondents wherein it is stated in Paragraph 9 as follows:-

“9. It is further submitted that the Board considered the petitioner for selection in the 2013 recruitment. The petitioner belongs to BC(W) Category. The last candidate selected in B(W) is 75.21 and BC (G) 75.22. The petitioner has secured only 71.52. Since the petitioner has not secured eligible cut off marks, she was not considered for selection.”

The above extract clearly shows that the petitioner has not secured the eligible cut off marks. Hence, she was not considered for selection.

In view of the above statement, the petitioner is not entitled for the relief sought for in the Writ Petition. The Writ Petition fails and the same is dismissed. Connected Miscellaneous Petition is closed. No costs.
