Prayer: Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of mandamus to direct the respondent to consider the petitioner's representation and grant the educational loan to continue her studies in GNM (Nursing) Course for the years 20122016 at St.Mary's Institute of Nursing, Bangalore.

The petitioner seeks for issuance of a writ of mandamus to direct the respondent Bank to sanction educational loan to the petitioner to enable her to pursue G.N.M. (Nursing) Course, for the year 2012-2016, at St.Mary's Institute of Nursing, Bangalore.

According to the petitioner, she hails from a family, which is living below poverty line and she is unable to pay the fees for undergoing the Course and the respondent Bank is not even issuing application form for grant of educational loan and therefore the petitioner has approached this Court by filing this writ petition.

In the light of the above stand, without going into the merits of the petitioner's claim, there will be a direction to the respondent Bank to consider the petitioner's claim and issue application form to the petitioner for the purpose of availing educational loan, within a period of three weeks from the date on which the petitioner or her parents approach the respondent Bank. On furnishing such application, the petitioner shall duly fill up and submit the same to the respondent Bank and on receipt of such application form, the respondent Bank shall consider the same in accordance with the Scheme. It is made clear that mere issuance of application form should not be misunderstood that this Court has directed to grant educational loan, which shall be done by the https://hcservices.ecourts.gov.in/hcservices/ respondent Bank in accordance with the Scheme

With the above observation, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
