Prayer:- Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the Inspector of Police, Kulathur Police Station, Vilathikulam Taluk, Tuticorin District to grant police protection to the petitioner to conduct festival for Arul Mighu Sri Pathrakaliamman Temple and Sri Rathina Vinayagar Temple belonged to Ahamthupuram Hindu Nadar Uravin Murai by considering the representation of the petitioner dated 22.06.2014. In this Writ Petition the petitioner seeks for issuance of a Writ of Mandamus, to direct the Inspector of Police, Kulathur Police Station, Vilathikulam Taluk, Tuticorin District to grant police protection to the petitioner to conduct festival for Arul Mighu Sri Pathrakaliamman Temple and Sri Rathina Vinayagar Temple belonged to Ahamthupuram Hindu Nadar Uravin Murai by considering the representation of the petitioner dated 22.06.2014.

Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.

On a suggestion made by this Court that parties should work out amicable settlement in the matter, the case was adjourned today.

Today, the learned counsel appearing for the petitioner as well as the learned counsel appearing for the sixth respondent have filed joint memo, wherein they have agreed to celebrate the Temple festival from 11.08.2014 to 13.08.2014 by constiuting a joint committee and the joint memo reads as follows:-

“1) Both the parties hereby agreed that the Temple festival will be celebrated on and from 11.08.2014 to 13.08.2014 by constiuting a joint committee.

2) Both the parties hereby agreed that the festival

will be conducted jointly by the petitioner M.P.Rathinasamy Nadar & S.Kanagaraj and the representatives namely 1) V.Marganda Nadar 2) M.Gurusamy Nadar of Kshathiriya Nadar Uravinmurai Sangam, Sippikulam being the members of the joint committee.

3) Both the parties hereby agreed that the

Thalakkattuvari has to be collected from the members of the sixth respondent Sangam and they have to be permitted to participate in the festival. The temple festival in the coming years will be decided in the Nadar Community people in the Village.

4) Both the parties hereby agreed that there will be no first honour to anybody.”

In the light of the joint memo, the Writ Petition is disposed of recording the agreement in the joint memo filed by this Court today ie., 05.08.2014 and both the parties shall abide by the contents of the joint memo. However, for other regular aspects such as establishment of sound system and regularising the Traffic, the Police authorities may be requested to control the Traffic and other related matters.

With the above direction, this Writ Petition is disposed of. No costs.
