PRAYER: Petition is filed under Section 482 of the Code of Criminal Procedure praying to direct the learned Principal District Judge (PCR), Pudukkottai, Pudukkottai District, to accept the surrender of the petitioner and to consider the bail application on merits on the date of surrender in Crime No.437 of 2013 on the file of the Inspector of Police, Ganeshnagar Police Station, Pudukkottai District on the very same day and pass such further or other orders as this Court may deem fit and proper in the circumstances of the case.

The petitioners seek a direction to the learned Principal District Judge (PCR), Pudukkottai, Pudukkottai District, to consider bail application on the same day of their surrender in respect of Crime No.437 of 2013 on the file of the respondent, pending investigation.

2.The petitioners are accused for offences punishable under Sections 294(b), 448, 323, 324 379 NP and 506(ii) of IPC r/w 3(1) (x) of SC/ST (Prevention of Atrocities) Act, 1989.

3.The submissions made by the learned Counsel for the petitioners and the learned Government Advocate(Crl. side) representing the respondent were heard. The materials available on record were also perused.

respect of offences punishable under the Schedule Castes and Scheduled Tribes(Prevention of Atrocities) Act, 1989 and that taking into custody of the petitioners pending consideration of bail application could cause them irreparable hardship, this Court considers it appropriate to direct the learned Principal District Judge (PCR), Pudukkottai, Pudukkottai District, to consider and dispose the bail application to be filed by the petitioners on the same day itself in connection with the case in Crime No.437 of 2013 on the file of the respondent police. Accordingly, this Criminal Original Petition is ordered.
