PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioners/A1 to A3, who are arrayed as accused, pray for the grant of anticipatory bail under Section 438 of Cr.P.C. for the offences punishable under Sections 403, 405 and 420 IPC in Crime No.43 of 2013 on the file of the respondent police.

2.The case of the prosecution is that the de-facto complainant who is none other than the uterine sister of the first and third petitioner. The de-facto complainant has lodged a complaint by stating that the petitioners father was running a book shopl namely Jeyam and Vijam Book Centre for a very long period since 1971 after the petitioners father expired first and third petitioner became the owner of the above book centre by creating false legal heir certificate by suppress the de-facto complainant's name.

3 . Learned Counsel for the petitioners would submit that the petitioners are innocent and they have been falsely implicated in this case. He further submits that originally the de-facto complainant had executed a release deed on 06.12.2012 with regard to the above book shop and accepted to waive her right and now she came with a false allegation by suppressing her release deed.

4.Learned Counsel for the intervenor would submit that the Mediation could not succeed.

5.Learned Government Advocate(Crl.Side) submits that investigation is going on.

Accordingly, the petitioners are ordered to be released on bail in the event of their arrest or on their appearance before the learned Judicial Magistrate No.V, Madurai, within 15 days from the date of receipt of copy of the order and on each of them executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police, daily at 10.00 a.m., for a period of two weeks and thereafter as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
