PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :-

The petitioners pray for the grant of anticipatory bail under Section 438 of Cr.P.C for offences punishable under Section 306 of IPC in Crime No.194 of 2012.

2.Heard both sides.

¶15

3.After registration of complaint, a representation was also sent to the Superintendent of Police, Dindigul by the wife of the deceased stating that a letter was found in the bed of the deceased and in that letter it is written that the petitioners are liable for his death. Resisting the same, learned counsel for the petitioners submits that even though the above said letter was found on 6.8.2012 at 8.00 p.m, they does not say anything about the same in complaint, which was preferred at 10.30 p.m.

On consideration of the facts and circumstances of the case and submissions made, this Court is of the view that the petitioners can be granted the relief prayed for and accordingly;

(a) In the event of arrest by or on appearance before the respondent police;

¶18

(b) In the event of appearance before the learned Judicial Magistrate, (*)Palani, within 15 days from the date of receipt of copy of the order,

¶19

(i) the petitioners shall be enlarged on bail on each of them https://hcservices.ecourts.gov.in/hcservices/ executing a bond for Rs.10,000/-(Rupees Ten Thousand Only) with two sureties for the like sum to their satisfaction;

¶20

(ii)the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer;

(iii)the 1st petitioner shall be available for interrogation by the respondent police daily at 10.30a.m for two weeks and thereafter, as and when required and the 2nd petitioner shall be available for interrogation as and when required.
