Since common issues are raised, these writ petitions are heard together, treating W.P.(C)No.35102 of 2015 as the leading case, and are being disposed of by this common judgment.

W.P(C)No.35102 of 2015:- The petitioner, who is stated to be a businessman in Perinthalmanna Municipality, has filed this writ petition under Article 226 of the Constitution of India seeking a writ of mandamus commanding the respondents to make it mandatory for all stage carriages touching Perinthalmanna Municipality to use Manathumangalam Bus Stand/Bypass Road Bus Stand constructed in 1.35 Acres of land originally owned by the petitioner, in which the petitioner had constructed a building having a total built up area of 12,000 Sq.Ft. with necessary infrastructure required for a bus stand, which he had handed over to the 1^st respondent Municipality, as evidenced by Ext.P4 acknowledgement letter dated 18.03.2006, after executing a gift deed in favour of the Municipality. The petitioner has also sought for an appropriate writ, order or

direction prohibiting respondents 1 and 2 from proceeding with the establishment and construction of the new bus stand in the land in Re.Sy.Nos.99/1, 99/2, 99/3, 100/2 and 109/3 of Perinthalmanna Village, as stated in Ext.P8 press report dated 05.08.2015.

2.1. On 20.11.2015, when W.P.(C)No.35102 of 2015 came up for admission, this Court admitted the matter on file. The learned Standing Counsel took notice for respondents 1 and 2 and the learned Government Pleader took notice for the 3^rd respondent Regional Transport Authority, Malappuram. This Court passed an interim order dated 20.11.2015, which reads thus;

“It is bewildering as to why the existing bus stand constructed hardly nine years ago spending crores of rupees is not being put to full use. Steps if any, to construct a new bus stand in the alternative site shall be put on hold for a period of two months."

The said interim order, which was extended from time to time, was extended until further orders on 28.7.2016.

W.P(C)No.26215 of 2014:- The petitioner, a resident of Perinthalmanna Municipality and also the Convener of Valluvanad Welfare Society, has filed this writ

petition seeking a writ of mandamus commanding the respondent Municipality not to reclaim the paddy land in Re.Sy.Nos.99/1, 99/2, 99/3, 100/2 and 109/3 of Perinthalmanna Village for the construction of the proposed bus stand, before the available bus stands at Perinthalmanna Municipality are made fully operational. The petitioner has also sought for a writ of mandamus commanding the respondent Municipality to consider on merits Exst.P3 and P5 representations and take appropriate action thereon, after affording him an opportunity of being heard; and a writ of mandamus commanding the respondent Municipality to ensure that Manathumangalam Bus Stand is put to use, for the purpose it was constructed, before constructing yet another bus stand.

3.1. On 10.10.2014, when W.P(C)No.26215 of 2014 came up for admission, this Court issued notice by Special Messenger to the respondent Municipality. This Court passed an interim order dated 10.10.2014, which reads thus;

"It is submitted by the learned counsel for the petitioner that the land now proposed to be utilised for the purpose of bus stand is a paddy field. If it is

a paddy field as per the revenue records or as per the data bank entry in the draft notification published by the Local Level Monitoring Committee, no reclamation shall be done by the respondent Municipality until further orders."

In both the writ petitions, the respondent Municipality has filed counter affidavit, opposing the reliefs sought for. In W.P.(C)No.35102 of 2015, the petitioner has filed reply affidavit to the counter affidavit filed by the respondent Municipality.

In W.P.(C)No.35102 of 2015, by the order dated 01.02.2016, this Court appointed an Advocate Commissioner to conduct local inspection, who submitted an interim report dated 16.02.2016, which was followed by a final report dated 29.02.2016. By the order dated 06.04.2016 in I.A.No.4109 of 2016, Shri M. Ummer, President of Perinthalmanna Nagara Vikasana Samithy was impleaded as additional 4^th respondent. On 20.03.2016, the respondent Municipality has filed its objections to the report of the Advocate Commissioner. By the order dated 21.06.2016, the Regional Transport Authority, Malappuram was directed to examine the contentions raised in these writ petitions and also the

practical aspects, as discernible from the traffic now passing through Perinthalmanna Town, and file a report as to the decision taken by the respondent Municipality to establish and construct a new bus stand in Re.Sy.Nos.99/1, 99/2, 99/3, 100/2 and 109/3 of Perinthalmanna Village, as stated in Ext.P8 press report dated 05.08.2015 in W.P.(C)No.35102 of 2015. Pursuant to that order, the report of the Secretary of the Regional Transport Authority, Malappuram is placed on record, along with a memo filed by the learned Senior Government Pleader dated 13.07.2016.

On 20.03.2019, the respondent Municipality filed I.A.No.1 of 2019 in W.P.(C)No.35102 of 2015 seeking an order to accept Ext.R1(i) decision No.27 of the Municipal Council dated 28.07.2018 and Ext.R1(j) minutes of the meeting held on 24.07.2018, in the chamber of the Chairman of the Municipality and the decisions taken in that meeting, which was attended by the writ petitioner in W.P. (C)No.35102 of 2015, as additional documents, and also to permit the Municipality to proceed with the construction of the bus stand as proposed. In that interlocutory application,

the writ petitioner filed a counter affidavit dated 20.05.2019. On 20.12.2019, the respondent Municipality filed I.A.No.2 of 2019 in W.P.(C)No. 35102 of 2015 seeking an order to accept Ext.R1(k) report of the Circle Inspector of Police, who is the convenor of the Traffic Regulatory Committee, Perinthalmanna and Ext.R1(l) minutes dated 18.08.2018 of the Traffic Regulatory Committee, Perinthalmanna, as additional documents.

Heard the learned counsel for the petitioners, the learned Standing Counsel for Perinthalmanna Municipality and also the learned Government Pleader appearing for the official respondent.

The grievance of the petitioner in W.P. (C)No.35102 of 2015 is that the Bus Stand constructed in 1.35 Acres of land originally owned by the petitioner, i.e., Manathumangalam Bus Stand/Bypass Road Bus Stand is not being put to full use by making it mandatory for all stage carriages touching Perinthalmanna Municipality to use that bus stand, and the respondent Municipality is proceeding with the establishment of a new bus stand in the land in

Re.Sy.Nos.99/1, 99/2, 99/3, 100/2 and 109/3 of Perinthalmanna Village, as stated in Ext.P8 press report dated 05.08.2015. The grievance of the petitioner in W.P.(C) No.26215 of 2014 is that, before the available bus stands at Perinthalmanna Municipality are made fully operational, the respondent Municipality is taking steps to reclaim the paddy land in Re.Sy.Nos.99/1, 99/2, 99/3, 100/2 and 109/3 of Perinthalmanna Village, for the construction of the proposed bus stand. According to the petitioner, the respondent Municipality has to to ensure that Manathumangalam Bus Stand/Bypass Road Bus Stand is put to use, for the purpose it was constructed, before constructing yet another bus stand.

The Government order by which it was held that the land offered by Shri. Mohammed Mustafa (the petitioner in W.P.(C)No.35102 of 2015) is most suitable for the construction of bus stand and also the decision taken by the Municipal Council of Perinthalmanna Municipality to acquire 3 Acres of land near to the bypass in the Kozhikode Road for the construction of a bus stand were the subject matters in

W.P.(C)Nos.8016, 10596, 18690 and 35308 of 2005 filed before this Court. Those writ petitions ended in dismissal by Ext.P3 judgment dated 03.03.2006 of a Division Bench of this Court. Before the Division Bench, it was pointed out by Shri Mohammed Mustafa (the petitioner in W.P.(C)No.35102 of 2015) that he had offered 1.35 Acres of land for the bus stand, which can be transferred in the name of the respondent Municipality, after filling up the land at the level of the bypass road, free of cost, and that he will complete the work and handover the bus stand immediately on receipt of notice from the respondent Municipality. It was pointed out further that he had already obtained permission under the Kerala Land Utilisation Order, 1967 for filling up the land, which is lying contiguous to PWD bypass road. Before the Division Bench, Shri M.Ummer (the additional 4^th respondent in W.P.(C). No.35102 of 2015), who is the President of Perinthalmanna Nagara Vikasana Samithy and the petitioner in W.P.(C)No.35308 of 2005, agreed to surrender 3 Acres of land in the centre of Perinthalmanna Town. The Private Bus Operators Association, Perinthalmanna Unit, the petitioner in

W.P.(C)No.18690 2005, contended that the land offered by Shri M.Ummer is more convenient, as it is in the heart of the town with proximity to the Munsiff - Magistrate Court, PWD Office, Supply Office, Taluk Office, Government High School, Civil Station, Telephone Exchange, etc. During the pendency of those writ petitions, Shri Mohammed Mustafa, the petitioner in W.P.(C)No.35102 of 2015, completed the construction of the bus stand in 1.35 Acres of land, which was handed over to the respondent Municipality. He has also executed a gift deed in favour of the respondent Municipality. In Ext.P3 judgment, the Division Bench noticed that the Government, after local inspection and discussion with the authorities, found that the land offered by Shri Mohammed Mustafa is most suitable and passed orders and that land was transferred to the respondent Municipality. He levelled the land and constructed the bus stand with building and all facilities, on the basis of the agreement executed with the respondent Municipality. The Municipality has not chosen to challenge that Government order and there is no reason for the Municipality for not using the above bus stand. It is true

that Shri M.Ummer has also offered land. The contention of the Bus Operators Association is that only 40 buses can be parked in the land offered by Shri Mohammed Mustafa. The filling up of the land offered by Perinthalmanna Nagara Vikasana Samithy and the construction of buildings, etc. will take time and it has got an enormous financial liability. Before the Division Bench, it was the contended that the construction of a bus stand, in the heart of the town will only add traffic congestion. In Ext.P3 judgment, the Division Bench made it clear that they are not deciding which land is more suitable for the bus stand in a writ petition filed under Article 226 of the Constitution of India. The Government after discussion decided that the land offered by Shri Mohammed Mustafa is the most suitable land and on the basis of the Government decision he has already constructed the bus stand and the land and building were handed over to the Municipality after executing an agreement. Therefore, there is no reason for not using the above land. As stated by the learned Single Judge in the judgment in W.P.(C)No.19928 of 2004, there can be two bus stands after developing the

land offered by Perinthalmanna Nagara Vikasana Samithy, represented by its President Shri M.Ummer. Building can be constructed there also and that also can be used as bus terminal, depending upon the bus routes there. In view of the agreement and the Government order the Municipality is bound to open the bus stand to the public. The Municipality is legally bound to obey the Government order, i.e., Ext.P5 order in W.P.(C)No.18690 of 2005. Therefore, the Division Bench found no ground to set aside that Government order or the agreement executed by the Municipality and Shri Mohammed Mustafa.

Along with the counter affidavit filed in W.P. (C)No.26215 of 2014, the respondent Municipality has placed on record Ext.R1(j) Government order dated 04.12.2010, i.e., G.O.(Ms.)No.316/2010/ AD dated 04.12.2010, whereby the Government granted exemption under Section 10 of the Kerala Conservation of Paddy Land and wetland Act, 2008, from the provisions under the said Act, for the conversion of 3.02 Acres of paddy land in Sy.Nos.99/2B3 (64 cents), 99/1 (36 cents), 109/2 (36 cents), 109/3 (36 cents), 109/4 (27

cents), 109/4 (16 cents), 108/1 (21 cents), 99/2B4 (46 cents), 99/3 (55 cents), 100/2 (1.65 cents) and 100/2 (2.35 cents) in Perinthalmanna Village of Malappuram District for the construction of bus stand, subject to the condition that the drainage and irrigation canals, if any, in the site should be protected and should not in any way be blocked by the proposed construction in the paddy land. As per that order, the respondent Municipality should give an undertaking that the surrounding paddy land will not be hampered. The said Government order dated 04.12.2010 is not under challenge in both the writ petitions.

As evident from the documents placed on record as Exts.R1(i) and R1(j), along with I.A.No.1 of 2018, a meeting was convened on 24.7.2018 in the chamber of the Chairman of the respondent Municipality, which was attended to by the writ petitioner in W.P.(C).No.35102 of 2015. In the said meeting certain decisions were taken to ensure use of Manathumangalam Bus Stand/Bypass Road Bus Stand, even after the construction of the Jubilee Bus Stand. The decision taken in Ext.R1(j) minutes was placed before the Municipal

Council in its meeting held on 28.7.2018, which was approved by the Municipal Council unanimously, as evident from Ext.R1(i) decision. In Exts.R1(k), report of the Convener of the Traffic Regulatory Committee, Perinthalmanna, recommendations were made regarding traffic regulations in Perinthalmanna Municipality, which was considered by the Traffic Regulatory Committee as evidenced by Ext.R-1(l).

As already noticed hereinbefore, there can be two bus stands after developing the land offered by Perinthalmanna Nagara Vikasana Samithy, as held by a learned Single Judge of this Court in the judgment in W.P. (C).No.19928 of 2004, which was taken note of by the Division Bench in Ext.P3 judgment. As per those decisions, building can be constructed there also and that can be used as bus terminal, depending upon the bus routes there. Since the Government Order, ie., Ext.P5 order in W.P. (C).No.18690/2005 or the agreement executed by the respondent Municipality and Sri.Mohammed Mustafa were not set aside by the Division Bench and since Ext.P3

judgment has attained finality, the respondent-Municipality has to use Manathumangalam Bus Stand/Bypass Road Bus Stand constructed in 1.35 Acres of land, originally owned by the petitioner in W.P(C).No.35102 of 2015, even after the construction of new bus stand. In such circumstances, these writ petitions are disposed of by directing the respondent Municipality to take necessary steps to ensure the use of Manathumangalam Bus Stand/Bypass Road Bus Stand, in terms of the directions contained in Ext.P3 judgment of the Division Bench, and also the decision taken by the Municipal Council in Ext.R1(i).
