W.P.(C)No.18690 2005, contended that the land offered by Shri M.Ummer is more convenient, as it is in the heart of the town with proximity to the Munsiff - Magistrate Court, PWD Office, Supply Office, Taluk Office, Government High School, Civil Station, Telephone Exchange, etc. During the pendency of those writ petitions, Shri Mohammed Mustafa, the petitioner in W.P.(C)No.35102 of 2015, completed the construction of the bus stand in 1.35 Acres of land, which was handed over to the respondent Municipality. He has also executed a gift deed in favour of the respondent Municipality. In Ext.P3 judgment, the Division Bench noticed that the Government, after local inspection and discussion with the authorities, found that the land offered by Shri Mohammed Mustafa is most suitable and passed orders and that land was transferred to the respondent Municipality. He levelled the land and constructed the bus stand with building and all facilities, on the basis of the agreement executed with the respondent Municipality. The Municipality has not chosen to challenge that Government order and there is no reason for the Municipality for not using the above bus stand. It is true
