JUDGMENT

The petitioners are seeking for a direction to the respondent

to recast the seniority of the petitioners in tune with Rule 27(c) of the KS & SSR.

The first petitioner was appointed as Conductor in the

1^st respondent-Corporation and he joined service on 30.11.1988. The first petitioner was granted second grade on 12.9.1989 and first grade on 30.11.1997. He was granted Selection Grade on 30.11.2003 and Special Grade on 30.11.2006.

The second petitioner joined the service of the Corporation on 28.11.1988. The second petitioner was granted second grade on 6.10.1989 and first grade on 28.11.1997. He was granted Selection Grade on 28.11.2003 and Special Grade on 29.11.2006.

It is averred in the Writ Petition that in the draft gradation list of Conductors, dated 1.4.2009, the first petitioner is assigned Sl.No.713 and the 2^nd petitioner is assigned Sl.No.719. The petitioners have filed representations in the

matter as per Exhibits P4 and P5 raising their objections. It is pointed out that the representations are still pending without any consideration.

There will be a direction to the respondents to take a decision on Exhibits P4 and P5 after hearing the petitioners and any other affected parties within a period of three months from the date of receipt of a copy of this judgment.

The Writ Petition is disposed of as above.
