Plaintiff filed a suit for relief of partition and separate possession. It is the case of the plaintiff that, defendant No.1 is the distant relative and also seems to be grandmother of the plaintiff. It is contended that, as per the compromise between the parties on the appeal preferred by one Shivappa against the plaintiff and defendant No.1 in RSA.No.675/1991, the plaintiff and the defendant are in the joint possession of the suit property. It is contended that there is no partition effected between the plaintiff and defendant No.1. Hence, the plaintiff requested for partition and separate possession, for which the defendant did not give any heed to the request of the plaintiff. Hence, cause of action arose for the plaintiff to file suit for partition and separate possession.
