Heard the parties.

This criminal miscellaneous petition has been filed at the instance of the petitioner to cancel the bail granted to the opposite party no.2 vide order dated 30.01.2025 in A.B.A. No. 3338 of 2024.

Vide order dated 15.05.2026, the petitioner and the opposite party no.2 were directed to remain physically present in the Court on 19.06.2026 i.e. today.

The opposite party no.2 is present in the Court today. The petitioner is not present.

Learned counsel for the petitioner submits that the petitioner met with a Scooty accident hence, she could not come.

The opposite party no.2 who is present in the Court today submits that he saw the petitioner roaming in the Lalpania Market yesterday only in hale and hearty condition and the opposite party no.2 undertakes that he is ready and willing to keep and maintain the petitioner with full dignity and honour as his lawful wife as and when she resumes conjugal life with the opposite party no.2

Considering the aforesaid facts, this criminal miscellaneous petition is disposed of with a direction to the opposite party no.2

that as and when the petitioner comes to his house to resume conjugal life with the opposite party no.2, the opposite party no.2 will keep and maintain the petitioner with full dignity and honour as his lawful wife.
