The petitioner has been made accused in connection with S.T. Case No. 625 of 2025 arising out of Govindpur P.S. Case No. 400 of 2025, corresponding to G.R. No. 3365 of 2025 instituted under Section 109, 304(2), 317(2) of B.N.S, 2023.

Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner attempted to murder the informant by snatching her valuables kept in her bag while she was travelling in an auto rickshaw, due to which she fell down and sustained injuries. It is also alleged that the petitioner snatched away the valuables of the informant and handed it over to the co-accused, who has been admitted on bail by a co-ordinate Bench of this court vide order dated 17.02.2026 passed in B.A. No. 10446 of 2025. It is submitted that the allegation against the petitioner is false. It is further submitted by learned counsel for the petitioner that the petitioner has no criminal antecedent, as mentioned in paragraph 11 of the bail application. It is

next submitted that the petitioner has been in jail custody since 22.08.2025, as mentioned in para 12 of this bail application. It is next submitted by learned counsel for the petitioner that the petitioner is ready and willing to cooperate with the trial of the case hence, the petitioner may be admitted on regular bail.

Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that keeping in view of the serious nature of allegation against the petitioner of attempting to murder an innocent lady only because she was carrying valuable in her bag while she was travelling in an auto-rickshaw; there is every chance of the petitioner absconding, if released on bail and indulging in similar type of offences and the petitioner is a threat to the law and order in the locality and also there is chance of the petitioner tampering with the evidence. It is therefore submitted that the petitioner ought not be released on bail.

Considering the serious nature of allegation against the petitioner and the chance of his tampering with the evidence and absconding, if released on bail, this Court is of the considered view that this is not a fit case where the above-named petitioner be released on bail. Accordingly, the prayer for bail of the above-named petitioner is rejected at this stage.
