04/12.02.2026 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.

The petitioners are apprehending their arrest in connection with Criminal Misc. (Complaint) Case No.232/2017, registered for the offence under Section 33 of the Indian Forest Act, pending in the Court of the learned Judicial Magistrate, 1^st Class, Chatra.

Learned counsel appearing for the petitioners submits that the petitioners are earning their livelihood by way of doing the labour work. He further submits that only allegation is made that stone have been spread in Bhojpur gramin road. He then submits that the petitioner is having no criminal antecedent, as disclosed in paragraph 11 of this application.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of taking stone chips from the forest land and spread on the road.

Considering that the petitioners are said to be labour workers and they have got no criminal antecedent, as disclosed in paragraph 11 of this application and in that view of the matter, the petitioners are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions.

Accordingly, this application is disposed of.
