The petitioner is apprehending his arrest in connection with Barwadda P.S. Case No. 179 of 2025, registered for the offence under Sections 112(2), 317(4), 3(5) of the BNS, pending in the Court of the learned J.M.F.C., Dhanbad.

Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case only because Mustaque Ansari has talked with the petitioner on his mobile. He next submits that the petitioner is not named in the F.I.R.. He next submits that the petitioner has got no criminal antecedent, as disclosed in paragraph no.12 of the petition.

Learned counsel appearing for the State opposed the prayer and submits that the petitioner appears to be an accomplice of the apprehended accused.

Considering that the petitioner is having no criminal antecedent and Mustaque Ansari has talked with the petitioner on his mobile and in view of that the petitioner has been made accused. Apart from that, there is no allegation against the petitioner and in that view of the matter, the petitioner is directed to surrender before the learned Court within two
